Authorization to participate

I hereby grant permission for my child to attend the Education Française Greater Houston ("EFGH") classes and participate in cultural events (“Activities”), and I agree to the Terms and Conditions set forth herein. I confirm my intention to make them attend classes regularly and for the whole school year.

I understand that in case of unexpected events (pandemic, weather, etc.), classes can be offered alternately on campus or online according to the guidance and decisions of the State of Texas and Harris County, the health authorities, and the EFGH administration.
The classes occur under the direction of EFGH employees and volunteers.

All attendees shall be fit to travel and participate in EFGH Activities. I understand that if my child has any illness or condition that may prevent or limit my child from traveling or participating in any activity during EFGH Activities, it is my responsibility to disclose said limitations to EFGH and to consult with a medical physician before participation in EFGH Activities.

Payment

A non-refundable registration fee of $100 per student is required for the school year ($200 if registering after June 1st) and will be added to the tuition fees. Tuition fees are $1500 for the FLAM program and $1000 for the FLE program. A 5% discount will be applied to the total tuition fees when registering more than one child.

I will receive an invoice, and my registration will be confirmed once EFGH receives the payment. The following optional payment plans are available :

• By Zelle with one unique payment using email “directeur@efghouston.org”
• By check, with one unique payment payable to EFGH and mailed to
  EFGH, 14119 Swallowfield Dr, Houston TX 77077-1423
• By ACH with one unique payment. There is a 1% fee charged per payment
• By credit card with one, two, three, or four payments. There is a 3% bank charge per payment.

A late fee of $25 will be applied if payment is received more than 7 (seven) days after the due date specified on the invoice, or in the event of a bounced check. I understand and agree that I am committed to keeping my child enrolled in the EFGH program for the duration of the school year and will be responsible for paying the full tuition fees when due, even if I choose to withdraw my child from the program before the year’s end.

Refund policy for Registration fee

EFGH will refund the registration fee only if the selected class cannot be offered for any reason and no alternative solution is available. In all other cases, the registration fee is non-refundable.

Refund policy for Tuition fee

The tuition fee will be refunded in the following cases :
1. If, for any reason, the selected class cannot be offered and no suitable alternative solution is available.
2. If a student has a severe medical condition that prevents them from attending, a doctor’s note is required.
3. If a family relocates more than 50 miles away from Houston.

Emergency Closures

I understand that in the event of a natural or man-made disaster, or if tropical storm or hurricane warnings are issued for Harris County, the school may close to ensure the safety of all students and staff. I acknowledge that no refunds will be issued for classes cancelled due to such emergencies beyond the school’s control.

Assumption of the Risk

I understand that my child’s participation in EFGH Activities involves a certain element of risk, including serious injury and, although unlikely, the possibility of death. I understand the various types of activities involved in EFGH Activities that could potentially elevate the risk of serious injury or even death, such as physical activity, including eating, drinking, walking, running, skipping, dancing, physical exercises, jumping, and other activities that may be potentially hazardous regardless of the care taken to avoid injuries and illness and/or allergies and may cause bodily harm. I am comfortable in assuming full and complete responsibility for, and risks of, death, personal or bodily injury, disability, and/or property damage resulting from, in connection with, or in any way related to, my child’s participation in EFGH Activities. I understand that EFGH recommends that my child consult a physician before engaging in EFGH Activities and that they should not partake in such EFGH Activities unless medically able and in proper health. I assume the risk of injury/illness during EFGH Activities, including during transportation.

Novel coronavirus or any other contagious illness

I acknowledge and agree that my child will not participate in classes or activities if they are feeling unwell, exhibiting symptoms of illness, or have been diagnosed with a contagious condition, including but not limited to the flu, cold, or the novel coronavirus. I understand that the health and safety of all participants is a priority. As such, I agree to keep my child at home if they are showing any signs of illness. If my child becomes ill during the class, I agree to pick them up and remove them from participation until they are symptom-free to return to class.

Medical Treatment

I grant my authorization and consent for EFGH to administer general first aid treatment for any minor injuries or illnesses experienced by my minor child. If the injury or illness is life-threatening or if my child needs emergency treatment, I authorize EFGH to summon any and all professional emergency personnel to attend, transport, and treat my minor child. I agree to assume financial responsibility for all medical care expenses and/or transportation incurred.

Conduct during activity

I understand that my child’s participation in EFGH Activities is a privilege, not a right. I acknowledge that I have spoken with my child about my child’s need to comply with the specific rules and requirements established for EFGH classes, including rules of conduct outlined in federal and state regulations and laws. I understand that all such restrictions apply to my child during EFGH Activities. I agree that my child is expected to abide by all rules and directions from EFGH Activities organizers, employees, administrators, chaperones, and volunteers. Failure to do so could result in my child being sent home and my child’s continued participation in EFGH Activities being refused, without a refund of my fees paid for EFGH Activities. I further agree that my child will abide by the rules and requirements of EFGH Activities and participate in all planned activities (unless excused by an EFGH Activities organizer, employee, administrator, chaperone, or volunteer).

Waiver and Release

I, acting as the parent or legal guardian of the minor listed herein, do hereby agree to the terms of this Waiver regarding my child’s participation in EFGH Activities. Having read this Waiver and knowing the facts described above, I, for myself, my child, and ALL respective guardians, heirs, executors, personal and legal representatives, estates, beneficiaries, administrators, successors, and assigns (all of the foregoing, collectively the “Releasors”), do hereby WAIVE, RELEASE AND FOREVER DISCHARGE, AND COVENANT NOT TO SUE, ORGANIZERS OF EFGH ACTIVITIES, AWTY INTERNATIONAL SCHOOL, THEIR RESPECTIVE OFFICERS, DIRECTORS, TRUSTEES, SHAREHOLDERS, OWNERS, MANAGERS, PARTNERS, EMPLOYEES, STAFF, VOLUNTEERS, CHAPERONES, AGENTS, AND SUPERVISORS AND THEIR SUCCESSORS AND ASSIGNS (collectively the “Releasees”) from any all liability and/or claims, suits, damages, injury, disability, death, costs and expenses, whether arising before, during or after EFGH Activities, and whether caused by the sole or joint negligence, gross negligence, or tortious act or omission of the Releasees or any third party (collectively the “Claims”). The Releasors hereby knowingly and voluntarily waive, to the fullest extent permitted by law, the benefits of any statute, law, rule, or common law that may limit the scope of this Waiver.

I, and all Releasors, also hereby agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Releasees from any and all claims, liabilities, and costs asserted by or on behalf of us or any of our legal representatives, heirs, successors, and assigns within the scope of the release above. In consideration of my child having the privilege of participating in EFGH Activities and acknowledging that my child and I accept responsibility for his/her actions at all times, we hereby assume the risk of and release and hold harmless the Releasees from any and all injury to or damage by my child during EFGH Activities. I agree to be financially responsible for any and all damages, costs, or fees for which any of the Releasees may be liable as a result of my child’s conduct.

If this Waiver is found to be invalid, unenforceable, or void, in whole or in part, for any reason, then the Releasors acknowledge and agree that in no event, including, without limitation, the negligence, gross negligence, or willful misconduct of the Releasees shall the Releasees’ aggregate liability to Releasors or any other person exceed any applicable insurance limits, and in no event shall Releasees be liable to any person for special, incidental, consequential, or punitive damages or for any indirect damages such as, but expressly not limited to, exemplary damages or lost earnings, lost revenues or loss of consortium, or companionship (even if the Releasees have been advised of the possibility of such damages) whether based upon statute, contract, tort, negligence, strict liability, or otherwise.

The Releasors represent and warrant to the Releasees that (i) the child has no medical condition (physical or mental) that would or could impact allowing the child to participate in EFGH Activities and that the child is physically and mentally able to participate in EFGH Activities (ii) the child is not taking any herbal or medicinal supplement or prescription that could impact the child’s participation in EFGH Activities.

I am aware of and understand fully the potential risks involved in connection with EFGH Activities and that I may choose NOT to allow my child to participate in EFGH Activities at my sole discretion. I agree and acknowledge that the description of the inherent risks associated with EFGH Activities, as set forth herein, is not complete and that other unknown or unanticipated risks may arise. I understand that my child’s participation in EFGH Activities is purely voluntary and that I can refuse to sign this Waiver. I also understand that if I refuse to sign, my child will not be permitted to participate in EFGH Activities.

Furthermore, I acknowledge that I have received the opportunity (and have been strongly encouraged) to review this Waiver with an attorney, that I have carefully read and fully understand its contents, that I have been asked and received answers to all questions I may have, and that I have executed this Waiver freely and voluntarily, intending and agreeing to be fully bound by the terms hereof.

The parties agree to conduct business electronically pursuant to the Texas Uniform Electronic Transactions Act and the federal Electronic Signatures in Global and National Commerce Act in connection with this Agreement, including, but not limited to, the use of electronic signature, delivery, and retention, which shall have the same force and effect as the handwritten signature of a paper document and physical delivery and retention thereof. Each party hereby waives any objection to the validity, admissibility, or enforceability of an electronically signed, delivered, or retained copy of this Agreement or any document executed in connection with the basis that such document was electronically signed, delivered, or retained.
