WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT FOR CAMPS

Authorization to participate

I hereby grant permission for my child to attend the Education Française Greater Houston ("EFGH") Camp and agree to the Terms and Conditions set forth herein. This camp occurs under the direction of EFGH employees and volunteers.
All Camp attendees shall be fit to participate in the EFGH Camp. I understand that if my child has any
illness or condition that may prevent or limit my child from participating in any activity during the EFGH camp, it is my responsibility to disclose said limitations to EFGH and to consult with a medical physician before participation in the EFGH Camp.

Payment

I will receive an invoice, and my registration will be confirmed once EFGH receives the payment. The following payment options are available :

• By Zelle, with one unique payment, using the email “directeur@efghouston.org”
• By check, with one unique payment payable to EFGH and mailed to EFGH, 14119 Swallowfield Dr, Houston TX 77077-1423
• By ACH with one unique payment. There is a 1% fee charge per payment
• By credit card with one unique payment. There is a 3% bank charge per payment.

A late fee of $25 will be applied if my payment arrives more than 7 (seven) days after the due date
indicated on the invoice or in the event of a bounced check.

Refund policy

All fees are non-prorated and non-refundable. In the event of a natural or man-made disaster, or if tropical/hurricane warnings are issued in Harris County, the camp will be closed for the safety of our campers. If the camp must be suspended for the entire week due to such circumstances, we will share the loss with registered families by offering a 50% refund of the registration fee for that week.

Assumption of the Risk

I understand that my child’s participation in the EFGH Camp involves a certain element or risk, including serious injury and, although unlikely, the possibility of death. I understand the various types of activities involved in the EFGH Camp that could potentially elevate the risk of serious injury or even death, such as physical activity, including eating, drinking, walking, running, skipping, dancing, physical exercises, jumping, and other activities that may be potentially hazardous regardless of the care taken to avoid injuries and illness and/or allergies and may cause bodily harm. I am comfortable in assuming full and complete responsibility for, and risks of, death, personal or bodily injury, disability, and/or property damage resulting from, in connection with, or in any way related to, my child’s participation in the EFGH Camp. I understand that my child should not partake in such activities unless medically able and in proper health. I hereby assume the risk of injury during the entirety of the EFGH Camp, including during transportation if a field trip is organized.

Field Trip

I understand that my child’s participation in EFGH Camp may include a field trip, and I grant permission for my child to participate in this field trip event, which requires transportation.

Novel coronavirus or any other contagious illness

I acknowledge and agree that my child will not participate in camps or activities if they are feeling unwell, exhibiting symptoms of illness, or have been diagnosed with a contagious condition, including but not limited to the flu, cold, or the novel coronavirus. I understand that the health and safety of all participants is a priority. As such, I agree to keep my child at home if they are showing any signs of illness. If my child becomes ill during the class, I agree to pick them up and remove them from participation until they are symptom-free to return to camp.

Medical Treatment

I grant my authorization and consent for EFGH to administer general first aid treatment for any minor injuries or illnesses experienced by my minor child. If the injury or illness is life-threatening or if my child needs emergency treatment, I authorize EFGH to summon any and all professional emergency personnel to attend, transport, and treat my minor child. I agree to assume financial responsibility for all medical care expenses and/or transportation incurred.

Conduct during activity

I understand that my child’s EFGH Camp participation is a privilege, not a right. I acknowledge that I have spoken with my child about my child’s need to comply with the specific rules and requirements established for EFGH Camp, including rules of conduct outlined in federal and state regulations and laws. I understand that all such restrictions apply to my child during EFGH Camp. I agree that my child must abide by all rules and directions from the EFGH Camp organizers, employees, administrators, chaperons, and/or volunteers. Failure to do so could result in my child being sent home and continued participation in the EFGH camp refused, without refund of my fees paid for the EFGH Camp. I further agree that my child will abide by the specific rules and requirements of the EFGH Camp and will participate in all planned activities (unless excused by an EFGH Camp organizer, employee, administrator, chaperon, and/or volunteer).

Waiver and Release

I, acting as the parent or legal guardian of the minor listed herein, do hereby agree to the terms in this Waiver regarding my child’s participation in the EFGH Camp. Having read this Waiver and knowing the facts described above, I, for myself, my child, and ALL respective guardians, heirs, executors, personal and legal representatives, estates, beneficiaries, administrators, successors, and assigns (all of the foregoing, collectively the “Releasors”), do hereby WAIVE, RELEASE AND FOREVER DISCHARGE, AND COVENANT NOT TO SUE, ORGANIZERS OF THE EFGH CAMP, AWTY INTERNATIONAL SCHOOL, THEIR RESPECTIVE OFFICERS, DIRECTORS, TRUSTEES, SHAREHOLDERS, OWNERS, MANAGERS, PARTNERS, EMPLOYEES, STAFF, VOLUNTEERS, CHAPERONES, AGENTS, AND SUPERVISORS AND THEIR SUCCESSORS AND ASSIGNS (collectively the “Releasees”) from any all liability and/or claims, suits, damages, injury, disability, death, costs and expenses, whether arising before, during or after the EFGH Camp, and whether caused by the sole or joint negligence, gross negligence, or tortious act or omission of the Releasees or any third party (collectively the “Claims”). The Releasors hereby knowingly and voluntarily waive, to the fullest extent permitted by law, the benefits of any statute, law, rule, or common law that may limit the scope of this Waiver.
I, and all Releasors, also hereby agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Releasees from any and all claims, liabilities, and costs asserted by or on behalf of us or any of our legal repr sentatives, heirs, successors, and assigns within the scope of the release above. In consideration of my child having the privilege of participating in the EFGH Camp and acknowledging that my child and I accept responsibility for his/her actions at all times, we hereby assume the risk of and release and hold harmless the Releasees from, any and all injury to or damage by my child during the EFGH Camp. I agree to be financially responsible for any and all damages, costs, or fees for which any of the Releasees may be liable as a result of my child’s conduct.
In the event that this Waiver is found to be invalid, unenforceable, or void, in whole or in part, for any reason, then the Releasors acknowledge and agree that in no event, including, without limitation, the negligence, gross negligence, or willful misconduct of the Releasees shall the Releasees’ aggregate liability to Releasors or any other person exceed any applicable insurance limits, and in no event shall Releasees be liable to any person for special, incidental, consequential, or punitive damages or for any indirect damages such as, but expressly not limited to, exemplary damages or lost earnings, lost revenues or loss of consortium, or companionship (even if the Releasees have been advised of the possibility of such damages) whether based upon statute, contract, tort, negligence, strict liability, or otherwise.
The Releasors represent and warrant to the Releasees that (i) the child has no medical condition (physical or mental) which would or could impact allowing the child to participate in the EFGH Camp and that the child is physically and mentally able to participate in the EFGH Camp (ii) the child is not taking any herbal or medicinal supplement or prescription that could impact the child’s participation in the EFGH Camp.

I am aware of and understand fully the potential risks involved in connection with the EFGH Camp and that I may choose NOT to allow my child to participate in the EFGH Camp at my sole discretion. I agree and acknowledge that the description of the inherent risks associated with the EFGH Camp, as set forth herein, is not complete and that other unknown or unanticipated risks may arise. I understand that my child’s participation in the EFGH Camp is purely voluntary and that I can refuse to sign this Waiver. I also understand that if I refuse to sign, my child will not be permitted to participate in the EFGH camp.
Furthermore, I acknowledge that I have received the opportunity (and have been strongly encouraged) to review this Waiver with an attorney, that I have carefully read and fully understand its contents, that I have been asked and received answers to all questions I may have, and that I have executed this Waiver freely and voluntarily, intending and agreeing to be fully bound by the terms hereof.

The parties agree to conduct business electronically pursuant to the Texas Uniform Electronic Transactions Act and the federal Electronic Signatures in Global and National Commerce Act in connection with this Agreement, including, but not limited to, the use of electronic signature, delivery, and retention, which shall have the same force and effect as the handwritten signature of a paper document and physical delivery and retention thereof. Each party hereby waives any objection to the validity, admissibility, or enforceability of an electronically sign, delivered, or retained copy of this Agreement or any document executed in connection on the basis that such document was electronically signed, delivered, or retained.
